Topic: The Intersection of ADA, FMLA and WC and Challenges of Administering the Intersection

Navigating employee leave and accommodation obligations can be one of the most complex responsibilities facing HR professionals. This session will explore the intersection of the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and Workers’ Compensation (WC), with a focus on the practical challenges employers encounter when administering these overlapping laws.
Attorney Mike Wagner will provide guidance on recognizing when multiple regulations apply simultaneously, coordinating leave and accommodation requirements, managing return-to-work situations, and reducing compliance risks. Through discussion of common workplace scenarios and best practices, participants will gain a better understanding of employer responsibilities and strategies for effectively managing employee absences, medical restrictions, and disability-related issues.
This program is designed to help HR professionals strengthen their knowledge of leave administration, improve compliance efforts, and navigate complex employee relations situations with greater confidence.
Biographical Details:
Attorney Mike Wagner:
Mr. Wagner is a founding partner of the Law Firm of Michael J. Wagner, Attorney At Law, P.C. He served as an Adjunct Professor of Human Resource Management at the Saint Francis University Graduate School of Industrial Relations and Human Resource Management. For approximately 20 years Mr. Wagner taught employment law, employment discrimination law, as well as workers compensation. Mr. Wagner has served as a Hearing Committee Chairman for the Disciplinary Board of the Supreme Court of Pennsylvania. He is former member of the House of Delegates of the Pennsylvania Bar Association. Currently, he is a member of the Workers Compensation and Employment Law Sections of the Pennsylvania Bar Association. Mr. Wagner concentrates his practice in workers compensation and employment law. Mr. Wagner has been selected every year from 2006 through 2022 as a Pennsylvania Super Lawyer®
Mr. Wagner is Past President of the Board of Directors for the Blair Regional YMCA. Currently he serves as Secretary for the Blair Regional YMCA Board. He is a charter member of the Rotary Club of Altoona-Sunrise, where he is a two-time past President and a current Board member. Mr. Wagner currently sits on the Board of Directors for the Southern Alleghenies Management Group. Previously, he was a Board member of the Central Pennsylvania Humane Society. He currently serves the shelter as their Pro Bono Solicitor. Mr. Wagner resides with his wife, Chrissey, in Hollidaysburg, PA
